The civil action for Wrongful Death has to be brought on by the decedent’s personal representative, also know as the executor of the estate. The executor can bring the claim on behalf of all the decedent’s survivors who are legally entitled to recover damages. Survivors can include a spouse, parent, children, and other lineal descendants. The estate itself has claims for medical and funeral expenses and lost net accumulations of the person who died. Allowable damages recovered are specified in the Florida Wrongful Death Act.
